Job Description Summary
Responsible for performing duties relating to litigation, legal documentation and collection activity.
Essential Job Functions
Prepares litigation packages for forwarding to local counsel for Equipment Financing/Leasing and all servicing clients. Responds to requests from outside attorneys for updates or additional information.
Prepares acceleration and demand letters for all leasing, Bank of the West and client portfolios. Maintains files regarding proof that such correspondence was sent.
Calculates amounts due on defaults, new or existing litigation accounts, considering such issues as current net balance, late fees, post judgment interest, collection costs, legal expenses, sales tax and property taxes using formulas based upon documents of various portfolios and clients.
Files Proof of Claims in bankruptcy cases for leasing and Bank of the West Broker portfolios. Follows with Trustees regarding timely release of our collateral.
Works with Asset Manager and Special Assets Divison (SAD) Workout Officers to prepare accounts for assignment to outside collection agencies.
Contacts and works with SAD accounts to effect workout arrangements, settlements and repossessions under the guidance of SAD Workout Officers. Updates electronic hard copy files.
Other Job Duties
Inputs and retrieves data utilizing knowledge of various computer software packages, including maintaining reports on SAD account status for Leasing and Bank of the West Broker portfolios
Answers telephone and provides information in accordance with bank policy.
Performs other duties as assigned.
Associates Degree or equivalent work experience
Requires 5 years minimum experience in restructuring or legally resolving customers who do not pay per the lease contract
Ability to manage caseload of past due customers to find optimal workout resolution for Bank of the West
Ability to work with internal and external legal resources in cases of contract dispute or litigation
Good knowledge of legal terminology and processes.
Experience in supporting a litigation function may be required.

Written and verbal communication.
Use personal computer, including knowledge of Word (or equivalent program), Excel, and PowerPoint.
